What is a "Bill of Particulars?" NY Attorney Gerry Oginski Explains

Do you know what a summons and complaint is? Do you know what an answer is? Do you know what authorizations are? Do you know what a bill of particulars is?

In this video I discuss what a bill of particulars is and how it applies in a civil lawsuit involving an accident case or medical malpractice or wrongful death case here in the state of New York.

A bill of particulars is an important document that gives the defense attorneys a specific understanding of exactly what your allegations are and what injuries you suffered as result of carelessness.

Your attorney is obligated to provide this document to the defense lawyers at the beginning of the litigation to give them an idea of exactly what your claims are. If your theories of liability change or your injuries change during the course of litigation, your attorney must notify the defense lawyers as soon as possible. If they fail to do so, it may be difficult to have a jury consider those changed theories of liability for your additional injuries. The defense will often claim they had no notice of these new claims or new injuries and did not have the opportunity to evaluate them properly.
