There is a big difference between malpractice (deviation in the standard of care) and maloccurence (a less than ideal outcome, which may have been due to the initial injury, a complication of a procedure or medication, or expected disease progression). A preliminary medical review by a physician represents a critical factor in whether an attorney pursues a case.
