This blog is a guide for victims of medical malpractice and accidents in Brooklyn, Bronx, Queens, New York, Staten Island, Nassau and Suffolk, by providing information they need to know before ever walking into a lawyer's office. For more info go to http://www.oginski-law.com or call Gerry at 516-487-8207 for answers to your legal questions. To the extent that this website discusses past cases the firm has handled, New York courts may deem this to be attorney advertising.

There is a big difference between malpractice (deviation in the standard of care) and maloccurence (a less than ideal outcome, which may have been due to the initial injury, a complication of a procedure or medication, or expected disease progression). A preliminary medical review by a physician represents a critical factor in whether an attorney pursues a case. I am an Emergency Physician in Connecticut and am the author of "Surviving the Emergency Room" (Amazon.com). You and your readers may find this book interesting. I have an interest in medical-legal issues and I have found many of your posts both accurate and interesting. -Ron Clark, M.D.
